Insurance carrier responsible for HOA required upgrades?

Hail storm hit a HOA controlled single family dwelling neighborhood.  People with 30 year + arch shingles are required to upgrade to 50 Year shake style designer shingles.  HOA is court filed legal entity.  Carriers are saying they are not responsible for upgrades under ordinance and law coverage.  Anyone have any experience with this situation?
